General Terms and Conditions:
The Terms and Conditions which follow will apply each time you use and interact with the Chatbot Services.
By using the Chatbot Services, you are taken to have read and agreed to the Terms and Conditions, Interior Savings Account Terms and Privacy Code. You also agree and understand that any other agreements that apply to any products and services that you may have with Interior Savings will also continue to apply when you use the Chatbot Services.
These Terms and Conditions and any amendments (the "Terms") are a legal agreement between you ("you" or "your") and Interior Savings ("Financial Institution", "we" or "us") for your use of the Chatbot Services, a feature that is accessible through the Interior Savings digital channels. Your continued use of the Chatbot Services means that you agree to the Terms as stated. If at any time you do not agree to these Terms or any changes we make to them: you must no longer use the Chatbot Services.
You also agree that Interior Savings can amend or replace these Terms at any time without providing you with a prior notice. By continuing to use the Chatbot Services after we post a notice of change, you agree to and accept the new or revised Terms provided as amended.
Chatbot Services:
The Chatbot Services are provided by a Third Party Provider (“TPP”) and is integrated into our digital channels to assist unauthenticated Interior Savings members in answering certain support or product questions about Interior Savings. The Chatbot Services is intended for informational purposes only and should not be used to make financial plans or decisions. You understandand agree that the Chatbot Services will not be able to answer every type of question you ask of it and Interior Savings is not responsible for any damage or loss you may suffer as a result.
Consents:
You understand that Interior Savings may collect personal information about you as you use the Chatbot Services. Personal information may include but is not limited to name, email address, phone number, or geolocation.
We or our TPP may use this information to provide or enhance the products or services, to facilitate the operation of the Chatbot Services and the development of the patterned data and machine learning it uses, to help us understand how our users use the Chatbot Services, and for our internal analytics and reporting.
When interacting with the Chatbot Services, we and our TPP may monitor and/or record the discussion for our mutual protection and to enhance the Chatbot Services and our customer service.
Your Responsibility:
You agree not to ask the Chatbot Services questions that include characteristics personal to you (such as, but not limited to your ethnicity or country of origin, colour or race, gender or sexual orientation, marital or family status, disability, religion). The Chatbot Services will collect device-related information including the make and model of your device, its operating system, geolocation, IP address, and the time and date of your use.
When you choose to provide Interior Savings with your personal information you consent to the use of your personal information as identified in these Terms, and as may be further identified at the time of collection. You may withdraw your consent to Interior Savings collection, use and disclosure of personal information at any time by submitting an opt-out request to Interior Savings Member Service Centre. If you withdraw your consent to certain uses of your personal information, you will no longer be able to use the Chatbot Services.
Interior Savings will keep your personal information only as long as Interior Savings needs it for legitimate business purposes and to meet any legal requirements. Please refer to the Privacy Code for further information regarding Interior Savings efforts to protect your privacy.
Any processing of personal information for children under the age of 16 shall only be permitted if consent is given by a parent or legal guardian. We encourage parents and guardians to observe, participate and monitor their children’s online activity. In the event that you become aware that Interior Savings has collected personal information from someone under the age of 16 without verification or parental consent, please inform us immediately.
Interior Savings may disclose information about you to the government or law enforcement officials or private parties as required by law, and disclose and use such information we believe necessaryor appropriate to (a) comply with applicable laws and law requests and legal process such as to respond to subpoenas or requests from government authorities; (b) enforce the terms and conditions that govern the service; (c) protect our rights, privacy, safety or property, and/or that of you or others; and (d) protect, investigate and deter against fraudulent, unauthorized, unethical or illegal activity.
You have a right to access your personal information we hold. To request a copy of your information we hold, please contact our Member Service Centre.
Limitation of Liability:
You acknowledge that Interior Savings or it’s TPP will not be liable for any losses or damages that you may suffer as result of your use or inability to use the Chatbot Services.
While Interior Savings is confident in the security levels of its systems, information sent over the internet may not be completely secure and the internet and related online systems may not function at all times. Accordingly, and to the extent permitted by Law, Interior Savings, and its TPP are not responsible for any loss or damages you may incur if a third party obtains access to your personal information transmitted over the Internet. Please refer to our Online Security policies to help protect your financial information.
Intellectual Property Protection & Confidentiality:
Interior Savings and its TPP own any software and Intellectual Property associated with the Chatbot Services, you are granted a limited, revocable, royalty-free, non-transferable, non-exclusive license to use the Chatbot Services on device(s) that you own or control. Interior Savings or its TPP can terminate this license at any time and with or without any reason.
You agree to indemnify and hold Interior Savings, TPP, and their respective affiliates, subsidiaries, officers, agents, directors, employees and other partners, harmless from any claim ordemand, including reasonable legal fees, made by any party arising out of your acts or omissions, breach of any Laws, your use of, or connection to the Chatbot Services; your violation of any terms in these Terms, or your violation of any third party rights, including Intellectual Property rights.
You agree to notify Interior Savings if you become aware of an infringement or misuse of the Intellectual Property rights of Interior Savings and/or it’s TPP. You will comply with all reasonable requests made by Interior Savings and/or it’s TPP in relation to the protection of its Intellectual Property rights.
If you become aware of any unauthorized decompilation or infringement of the Chatbot Services or any component thereof by any third party, you will promptly alert Interior Savings of such activity and provide the identity of such third party to Interior Savings. You will provide Interior Savings or its TPP with all reasonable assistance required by Interior Savings or its TPP to assert its rights against such third party and to the proceeds of such unauthorized activity.
You obtain no right to modify, duplicate or reverse-engineer any aspect of the Chatbot Services,
You will also not, directly or indirectly:
- modify, rent, loan, sublicense, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Chatbot Services;
- circumvent any userlimits or other use restrictions that are built into the Chatbot Services;
- remove any proprietary notices, labels, or marks from the Chatbot Services;
- access the Chatbot Services in order to:
- build a competitive product or service; or
- copy any ideas, features, functions or graphics of the Chatbot Services; or
- use the Chatbot Services in a manner that:
- infringes or violates the Intellectual Property Rights or any other rights of anyone else (including TPP);
- violates any law or regulation, including any applicable export control laws;
- is harmful, fraudulent, deceptive, threatening, harassing, defamatory, obscene, or otherwise objectionable;
- violates the security of any computer network, or cracks any passwords or security encryption codes; or
- runs any form of auto-responder or “spam” on the Chatbot Services, or any processes that run or are activated while you a not logged into the Chatbot Services, or that otherwise interferes with the proper working of Chatbot Services including by placing an unreasonable load on the Chatbot Service’s infrastructure);
Governing Law:
These Terms will be governed and construed in accordance with the laws of the Province of British Columbia, and the laws of Canada applicable therein. You agree that the courts of the Province of British Columbia will have exclusive jurisdiction to entertain any action arising under these Terms.
Defined Terms:
“Chatbot Services” means the chat interface that is integrated into the Interior Savings digital channels to assist unauthenticated Interior Savings customers in answering certain support or product questions about Interior Savings.
"Intellectual Property” means any right that is or may be granted or recognized under any legislation of Canada, any foreign country, or any political subdivision of any country, regarding patents, copyrights, neighbouring rights, moral rights, trademarks, trade names, service marks, domain names, industrial designs, mask work, integrated circuit topography, and any other statutory provision or common or civil law principle regarding intellectual property including trade secrets, or which may provide a right in either ideas, formulae, algorithms, concepts, inventions or know-how generally, or the expression or use of such ideas, formulae, algorithms, concepts, inventions or know-how, whether registered or unregistered, and including rights inany and all applications, registrations, licenses, sub-licenses, franchises, agreements or any other evidence of a right in any of the foregoing.
“Third Party Provider” or “TPP” means any party retained by Interior Savings to provide the Chatbot Services, on behalf of or otherwise to fulfill an obligation of Interior Savings under these Terms and Conditions.
